DLG Luce – San Antonio – San Antonio Food Truck Vendor File Lawsuit Against the City

As recently reported in the San Antonio Business Journal, four San Antonio based food truck vendors have filed a lawsuit against the City of San Antonio, which alleged that their ‘economic liberties’ have been violated by San Antonio’s mobile vending ordinance. 

The lawsuit, which was filed in Bexar County, challenges the constitutionality of a city law that bans ‘food trucks’ from operating within 300 feet of a brick and mortar restaurant without the restaurant’s permission. 

As stated in the lawsuit, ‘the city’s “actions deprive plaintiffs of their right to pursue a lawful occupation free from unreasonable government interference,” and violate the Texas Constitution’s right to economic liberty without fear of unreasonable interference.’

The plaintiffs in the case are local food truck owners Regino Soriano, the owner of El Bandolero; Bernardo Soriano, Regino’s son and the operator of El Bandolero II; Ricardo Quintanilla, the owner of Tacos el Regio; and Rafael Lopez, the former owner of El Bandera Jalisco.
