As recently reported in the Austin American Statesman, Federal Judge James Nowlin is frustrated with the pace in which the litigation involving Dilliards and Highland Mall is taking. As quoted in the article, Austin Federal Judge James Nowlin points out that that litigation, which was filed in March 2009 ‘exemplifies an inefficient progression from an intitial dispute to a final resolution.’

The article notes that the Austin based Judge is frustrated with wasted judicial resources and client’s money, that includes a retreat into bankruptcy that has delayed the proceedings. 

According to the article, Judge Nowlin has now ordered that both sides send somebody to an April settlement conference who has settlement authority.
