DLG Luce – Austin – State of Texas Sues Over Education Funds

As recently reported in the San Antonio Express News, the State of Texas has filed a lawsuit to get what it believes is its $830 million share of federal emergency funding allocated to prevent teacher layoffs. 

According to the article, the state of Texas has been blocked from its share of the $10 billion package becuase of legislation sponsored by Austin Congressman Lloyd Doggett. According to Doggett, his amendment was designed to prevent the governor from using federal stimulus money to supplant rather than supplement state education spending. 

The Texas Attorney General Greg Abbott filed suit in the United States Court of Appeals for the 5th Circuit. This, despite assurances from the United States Education Secretary Arne Duncan that Texas would eventually get its share of the money.
