DLG Luce – Austin & San Antonio – Texas Federal District Judge Rules Solicitation Ban Unconstitutional

As was recently reported in the San Antonio Express News, Texas Federal Court Judge Yeakel ruled that a 2009 restriction on solicitation passed by the Texas Legislature is an unconstitutional ban on free speech. 

Specifically, the Texas Judge ruled that it is unconstitutional to prevent medical professionals from contacting vitcims within 30 days of an accident. Also, the Court ruled that the Texas Legislature coundn’t prohibit lawyers from contacting people in writing within a month of their arrest. 

The office of Texas Attorney General Greg Abbott, which defended the law, is reviewing the opinion. The Texas Attorney General has 30 days to file a notice of appeal according to a spokesperson in the office.
