On Tuesday, April 7, Travis County Probate Court Judge Guy Herman okayed the post-mortem collecting of sperm from the 21 year old male victim of an assault on Sixth Street in Austin, Texas, who died on March 27th.
After an emergency hearing requested by the victims mother, Judge Herman issued orders to the Travis County medical examiner’s office to maintain the victims body until his sperm could be taken.
According to University of Texas Law Professor John Robertson, ‘state law gives parents control over a child’s body for donation of organs and tissues, but ‘this use is very unclear.’ University of Texas Professor Robertson went on to state that ‘there are no strong precedents in favor of a parent being able to request post-mortem sperm retrieval.’
