DLG Luce – Austin – Hearing Set in Perrys Legal Challenge to Gain Access to Virginia Ballot

As recently reported in the San Antonio Express News, a Court date has been set in Rick Perry’s lawsuit to gain ballot access in Virginia’s Republican presidential primary ballot. 

Perry, who failed to obtain the required amount of signatures to have his name on the ballot in Virginia in its March 6th primary, is seeking a Court order to have his name added to to ballot. By law, the ballots must be printed by January 9th, but his hearing has been set for January 13th. Federal Judge Gibney did state that if Perry prevails the ballots may have to be printed again. 

The Court did question why Perry decided to file in Federal Court, when he usually gives deference to the states over federal government. The Court noted that ‘it looks to me like it’s asking the federal government to get involved in state affairs.’
