As recently reported in the Austin American Statesman, a federal appelate court, the Fifth Circuit Court of Appeals, reversed a decision by Austin Federal Judge Sam Sparks finding that a controversial new Texas Abortion law violated the First Amendment. 

The 5th Circuit Court of Appeals ruled that the sonogram law fell within guidelines that allow states to regulate the practice of medicine in ways that do not place undue burden on a woman’s right to an abortion. The ruling negates an injunction that had been put in place by the district court. 

The Center for Reproductive Rights, which filed the lawsuit challenging the Texas law, is said to be evaluating a response, which may include asking the entire Fifth Circuit to reconsider the ruling and sekieng a review from the United States Supreme Court.
