DLG Luce – Austin Texas Supreme Court Will Hear Strip Club ‘Pole Tax’ Appeal

As recently reported in the Austin American Statesman, the Texas Supreme Court in Austin will hear appellate arguments regarding whether Texas’ $5.00 charge to strip club patrons violates the First Amendment right of free expression.

The Texas Supreme Court agreed to review an opinion rendered by a lower Texas Court which found that the ‘pole tax’ was improper because it singles out a form of expression, nude dancing, for regulation. 

The oral arguements before the Texas Supreme Court will actually take place in San Antonio, Texas on the campus of St. Mary’s University School of Law. The founding partners of DLG Luce LLP attended law school at St. Mary’s University School of Law.

In June, the Texas 3rd Court of Appeals in Austin issued a ruling, which affirmed the 2008 opinion of Texas State District Judge Scott Jenkins to the strike down the law, which was enacted in 2007. 

The arguments will be held on March 25.
