DLG Luce – Austin – Federal Court Judge Rules City Hall Ban Unconstitutional

As recently reported in the Austin American Statesman, Austin based Federal Court Judge Lee Yeakel has ruled that the City of Austin’s practice of issuing criminal tresspass notices at City Hall deprives people of their First Amendment rights to free speech. 

According to the Court ruling issued by Austin Judge Yeakel, the City of Austin’s system for allowing people to appeal their criminal trespass notices is also unconstitutional because it deprives them of their right to due process. 

The lawsuit which was filed in the Federal District Court of Judge Yeakel was filed after 37 protesters were arrested for disobeying a notice from the City of Austin prohibiting food distribution tables from 10pm to 6am. 

City of Austin spokesman Reyne Telles stated in the Austin American Stateman article that the City of Austin’s legal staff is reviewing the ruling and considering a possible Court appeal.
