DLG Luce – Austin – Austin Residents Intervene in Travis County Appraisal District Lawsuit

Recently report in the Austin Monitor, six Austin Travis County homeowners have filed a Motion to Intervene in Austin’s lawsuit against the Travis County Appraisal District. The homeowners are being representing by attorneys experienced in representing property owners who believe their property has been overvalued. 

The reasons for intervening in the lawsuit, according to the article, is to contest the City of Austin’s challenge to two sections of the Texas Tax Code.  According to the City of Austin’s petition, Section 41.43(b)(3) “forces the appraisal district to reduce individual property appraisals from market value to the median value of ‘a reasonable number of comparable properties.

The lawsuit is concerning in that it appears that homeowner’s might be trying to have certain homes appraised in a way that would not be uniform across the board. Austin Mayor Steve Adler is quoted in the article as stating “Property taxes should be based on market value and only market value. The people that are challenging our challenge are explicitly trying to support a law that allows some properties to be valued at something other than market value. This is fundamentally not fair.”
